On April 8, 2020, the U.S. Trade Representative (USTR) announced eight (8) extensions to China Section 301 List 1 product exclusions set to expire on April 18, 2020. These extended List 1 product exclusions cover certain roller machines, ratchet winches, counterweight castings, fork-lift tines and carriages, parts of metal shredders, watercraft steering wheels, pipe brackets, and voltage measuring instruments.  Clients may continue to utilize these extended List 1 product exclusions until April 18, 2021. 

 

The remaining thirteen (13) List 1 product exclusions granted on April 18, 2019 will expire on April 18, 2020 unless further extensions are announced.  Clients may still utilize these product exclusions for merchandise entered before the April 18, 2020 expiration date. 

 

For merchandise held in FTZs in Non-Privileged Foreign (NPF) status for production, based upon past Customs practice, no further action is necessary.  For merchandise held in FTZs in NPF status for distribution, we suggest that clients should consider immediately filing a Customs entry with a Non-Processing Stipulation to claim the product exclusion, which is the safest option.  Another option is to change the zone status to Privileged Foreign (PF) to attempt to take advantage of the existing product exclusion, but there may be issues with this approach.  Contact Marshall Miller with questions.
