There have been two recent webinars held by the U.S. International Trade Commission (ITC) and the National Association of Foreign Trade Zones, and the ITC has posted a basic FAQ document, but many questions on the ITC FTZ Questionnaire remain.

In preparing Questionnaire responses, clients are reminded that a primary focus is on NAFTA/USMCA U.S. FTZ production parity and duty deferral.  If FTZ clients have competitors that produce products in Mexico or Canada which qualify for NAFTA/USMCA duty-free treatment and do not pay duty deferral duties, the FTZ Questionnaire responses should emphasize the disparity and negative impact on your U.S. business.

 We urge clients to forward their draft ITC FTZ Questionnaires to our office for final review prior to submission.
